🇺🇸 California SB 54 plastic packaging EPR: final plan and fee schedule expected

The implementing details of California's SB 54 extended producer responsibility (EPR) law for plastic packaging, including the final plan and fee schedule, are expected in October 2026; public comment on the draft closed on 14 August 2026. This is the next key milestone for packaging exported to the US.

What to do: Packaging suppliers and brands with US packaging business should track the fee announcement, as the fees will feed directly into cost calculations.

🇪🇺 European Commission due to adopt implementing act on PCR content calculation methodology

The methodology will determine whether post-consumer recycled material (PCR) produced in China can count towards EU recycled content targets. 🇬🇧 UK Plastic Packaging Tax: pre-consumer scrap no longer counts as recycled content

The mass balance approach is introduced on the same date. The 2026/27 rate is GBP 228.82 per tonne, charged where recycled content is below 30%. Packaging that relies on pre-consumer production offcuts to reach 30% will no longer qualify in the UK.

What to do: Packaging suppliers and brands should switch to post-consumer recycled (PCR) material sources and obtain supporting evidence about 12 months in advance.

🇪🇺 EU PPWR 2030: recyclability grades, PCR minimums, empty space and hotel miniatures ban

Under the Packaging and Packaging Waste Regulation (PPWR): recyclability grades A ≥95%, B ≥80% and C ≥70% (only grades A and B permitted from 2038). Minimum post-consumer recycled (PCR) content: 30% for contact-sensitive PET packaging and 10% for contact-sensitive plastic packaging made from materials other than PET (cosmetic bottles and jars fall into this category, which is less demanding than the 35% for other plastic packaging). Empty space ratio for grouped, transport and e-commerce packaging: ≤50%. Note that Annex V, item 5 (single-use cosmetic packaging in the hospitality sector) contains neither the word 'plastic' nor any ml or g threshold, so the ban applies to all materials; switching to glass, paper or aluminium does not avoid it.

What to do: Packaging suppliers and brands should move early towards mono-material and easy-to-separate designs. Dark carbon-black bottles, multi-material composites and pumps with non-separable metal springs are at high risk of falling below grade C. For the hospitality channel, options include wall-mounted refillable dispensers and large-format refill pouches, which also represent a new product opportunity.

Structure and format innovation

Structure drives cost, tooling, user experience and visual appeal, making it the layer where packaging makers can differentiate most.

  • Airless pumps shift to mono-material (all-PP or all-PE) Regulation-driven
    Mono-material designs are easier to recycle and map directly onto the 2030 recyclability grades of the EU Packaging and Packaging Waste Regulation (PPWR). Multi-layer structures carry the highest risk of a lower grade.

    Keyrings, bag charms and mini cases are multiplying, reflecting the same consumer behaviour behind the rise of collectible, playful personal-care items.

Sustainable materials

Regulation and brands' environmental, social and governance (ESG) targets are pushing together, and materials now feature in most requests for quotation.

  • 30–50% post-consumer recycled (PCR) content becomes a common baseline Now a sourcing requirement
    Industry reports put bottles, jars and airless packs at around 39% of PCR use in cosmetic packaging. EU buyers increasingly list PCR supply capability as a sourcing requirement.
  • Aluminium gains ground Alternative route
    Brands such as Dieux and Grown Alchemist use aluminium tubes and jars. Mature metal recycling makes this a practical route to cutting plastic use and plastic-tax exposure.
  • Paper-based, mycelium, algae and sugarcane-based materials Premium trials
    Sulapac developed a camellia seed shell material for Chanel, reportedly recognised at Luxe Pack 2025, showing that premium lines are already trialling these materials.

Refillable and reusable

By 2026 refillability has moved from selling point to baseline consumer expectation, and it is also a hard PPWR requirement.

    Packaging refills as pods lowers the psychological barrier to refilling.

    Solutions such as Fill-Up refill tubes and Axilone replaceable-cartridge pencils show that refills must themselves be mono-material, or the refill becomes the unrecyclable part.
  • PPWR restricts single-use cosmetic packaging in hospitality from 2030 Fixed deadline
    Annex V, point 5 does not limit the restriction to plastic and sets no volume threshold, so switching to glass, paper or aluminium does not avoid it. Wall-mounted refill dispensers and large refill pouches are the main alternatives and create new product demand.

Regulatory intelligence

Regulation decides whether brands can keep using a given packaging type, making it a key variable in packaging orders.

  • EU Packaging and Packaging Waste Regulation (PPWR, EU 2025/40) EU
    Applies in full from 12 August 2026 with no grace period. From 2030 recyclability grades A, B and C apply alongside minimum PCR content; from 2038 only grades A and B are allowed. If cosmetic bottles and jars fall under contact-sensitive non-PET packaging, the PCR minimum is 10%, lower than the 35% for other plastic packaging.
  • California SB 54 US – California
    The law targets a 10% source reduction in plastic packaging by 2027, and 25% reduction with a 65% recycling rate by 2032. The recyclability of cosmetic pumps, tubes and multi-layer materials is under particular scrutiny. Implementing regulations are expected in October 2026.
  • UK Plastic Packaging Tax (PPT) UK
    The 2026/27 rate is £228.82 per tonne for plastic packaging with less than 30% recycled content. Under the announced changes, pre-consumer production scrap will no longer count as recycled content from 1 April 2027, so products relying on scrap to reach 30% need to switch to PCR sources and secure evidence roughly 12 months ahead.
  • Minnesota PFAS restrictions US – Minnesota
    This is the US state law that directly covers cosmetic packaging. The Minnesota Pollution Control Agency (MPCA) cites lipstick tubes as an official example; bottles, jars, tubes, pumps and droppers are in scope, while folding cartons, leaflets and shipping boxes are not.
  • Overhaul of extended producer responsibility (EPR) labelling Tooling and print
    From 12 February 2027 EPR participation marks must use QR codes or other digital markers, ending the printed Green Dot. From 12 August 2028 harmonised EU sorting labels become mandatory and member states may not keep national marks, so labels such as France's Triman will be replaced. New moulds and printing plates should reserve an interchangeable label area to avoid full write-offs in 2028.

Decoration and finishing

Decoration is a source of differentiation; where base material costs vary little, finishing often determines the price premium.

This is where trends turn into actual orders, and where Chinese packaging makers hold bargaining power.
